
St. Louis, Missouri May 13, 2025 (Issuewire.com) - Safety National Casualty Corporation, a Missouri-based insurer affiliated with Tokio Marine Holdings and part of the Tokio Marine Holdings Group, is facing intense criticism for alleged efforts to evade responsibility in ongoing litigation in New York Supreme Court, Westchester County (Case No: 61655/2025).
Plaintiff Matthew J. Fecteau has accused Safety National and its claims administrator, Sedgwick Claims Management Services, Inc., of improperly denying coverage related to constitutional violations committed by officials from the City of Mount Vernon. Fecteau contends that the insurers denial of coverage was executed without an adequate investigation, violating both New York State insurance law and explicit terms of the insurance policy.
"The actions of Safety National are deeply concerning," said Fecteau. "They have initially denied coverage explicitly, only to later contradict themselves by claiming they never issued such a denial. This type of conduct demonstrates an alarming disregard for accountability and fairness."
Court filings reveal that Safety National initially disclaimed coverage in September 2024, citing exclusions for intentional misconduct and civil rights violations. However, recent documents submitted by Safety National deny having ever made such a disclaimer, leading to allegations of deceptive practices and bad faith.
This controversy is not isolated, according to Fecteau, who points to previous cases in various jurisdictions where Safety National and its affiliates have similarly faced accusations and judicial reprimands for manipulative tactics and bad faith conduct.
"Regulatory oversight is urgently needed," Fecteau emphasized. "Safety Nationals apparent attempts to evade their responsibilities must be thoroughly investigated. Policyholders, and the public at large, deserve transparency and ethical practices from insurers entrusted with protecting our communities."
